Title IX of the Education Amendments of 1972, and its implementing regulation at 34 C.F.R. Part 106 (Title IX)
What is Title IX?
Title IX of the Education Amendments of 1972 is a federal law that prohibits sex discrimination in educational programs and activities.
What Constitutes a Title IX Violation?
Title IX violations include any behavior that may be considered discriminatory based on sex, including behaviors of sexual harassment, domestic or dating violence, sexual assault, and stalking.
At Eastern Nazarene College, any form of sexual harassment should be immediately reported, regardless of whether or not it seems to be a Title IX violation. The College will respond to all violations – both Title IX violations and non-Title IX sexual harassment violations.
Who is Protected under Title IX?
Any student or employee of the College is protected from sex discrimination by Title IX.
Is Title IX Compliance Optional?
Educational institutions that receive federal funding are covered by Title IX, and this is enforced by United States Department of Education’s Office for Civil Rights (OCR).
In compliance with Title IX, Eastern Nazarene College does not unlawfully discriminate on the basis of sex against students or applicants for admission, or employees or applicants for employment, or in the administration of its policies or in any aspect of its operations. The College will respond to reported violations of Title IX by conducting prompt, thorough, and equitable investigations, and providing supportive measures for those involved.
Reporting
Any member of the ENC community may alert the institution to a potential violation of ENC’s Title IX / sexual harassment policies.
Reports may be submitted through the reporting form (report a concern online) on this page, in person with the Title IX Coordinator or Deputy Title IX Coordinator, or by emailing TitleIX@enc.edu.

When To Report
Although a report may be made at any time, the College strongly urges that incidents are reported immediately. Measures of supportive care can diminish within hours of an incident, and resolution options narrow over time, especially if the College no longer has disciplinary jurisdiction over the person accused.
If an incident is currently taking place, get help by calling 911 (if off-campus) or ENC Security at 765-677-3911 (if on-campus) immediately.
Who Must Report
With few exceptions, all College faculty, staff, administrators, and student leaders (including Resident Assistants) are required to report any incident of any form of unwelcome sexual contact, sexual harassment, sexual assault, domestic or dating violence, and stalking.
Only those offices or individuals noted under the “Confidential Resource Providers” section below are exempt from the reporting requirement.
Amnesty Policy
Eastern Nazarene College is committed to working with victims of sexual misconduct from a trauma-informed ethos of care. ENC understands that some victims, and/or bystanders, of alleged sexual misconduct may be hesitant to report such incidents due to concern over their own possible violations of ENC policy. In such a situation, the victim of an alleged sexual misconduct incident may receive assistance, resources and supports without triggering the disciplinary process.
For example, if a student were sexually assaulted after attending a party where the student consumed alcohol, the student would not go through the College’s disciplinary process related to the violation of the College’s alcohol policy.

Prevention Education
- Coordinate the College’s sexual assault prevention plan
- Prepare and distribute educational materials
- Ensure that all employees and students receive Title IX education
Response Coordination
- Receive and promptly process any complaint or allegation about a reported behavior constituting a potential Title IX violation
- Receive and promptly process any Title IX-related inquiries from students, faculty, staff, students, and administrators
- Determine and coordinate appropriate interim supportive measures for all parties
- Ensure that all parties in a Title IX case receive appropriate notices, such as notices of allegations, rights, supportive measures, and decisions.
- Notify complainants of right to pursue remedies outside of the College’s Title IX process
- Monitor compliance of all requirements and timelines specified in the College’s Title IX procedures
- If not falling within the scope of Title IX, refer inquiries to other resources
